March ’21 – Last Month’s Results: Warnken, LLC Recovered $1,410,227.13 for 39 Injured Clients
Warnken, LLC once again recovered in excess of one million dollars for our injured clients last month. Thirty-nine cases concluded, either permanently, or, in the case of some workers’ comp cases, for now. Of the 39, four cases resulted in recoveries to the injured client in excess of $100,000. Please remember – to recover a specific sum – you generally need that level of injury. $100K recoveries come with $100K injuries. Million dollar recoveries are typically for million dollar injuries. Million dollar injuries are always life changing in a bad, bad way.

- Claimant tripped over board and fell, fracturing right leg. Treatment consisted of surgery, physical therapy and medications .

- Worker sustained neck and back injuries while working. The WCC “disallowed” the claim. An appeal was filed and the claim was settled between the parties which included payment for the post-injury outstanding medical care bills.

- Injury: Talus fracture and inferior lateral malleolus ligament injury
- Amount: $30,713
- Claimant fell down the steps, landing on the ankle and sustained a fracture. Surgery to repair the talus fracture and to remove a bone ossicle of the inferior malleolus, ankle ligament stabilization, and plantar fasciectomy of the plantar heel. Second surgery was an arthroscopic drilling of the lateral dome osteochondral defect legion, anterior cheilectomy, peroneal tendon debridement, and sinus tarsi debridement. After post-surgical therapy, the injured worker returned to work in the same position.

- Injury: Fracture of the femoral neck requiring a hemiarthroplasty
- Amount: $290,449
- Client slipped and fell and sustained a hip fracture. Surgery included a hemiarthroplasty. Subsequent Injury Fund was implead. WCC found Claimant was permanently totally disabled due to a combination of the work injury, his pre-existing medical conditions, and the worsening of the pre-existing conditions.

- Claimant sustained injury to the foot after falling from a raised box and twisting the ankle. Diagnosed with a lateral ligament injury. Claimant underwent conservative care with a foot and ankle specialist and returned to work for a different employer.

- Injury: Herniated discs at C5-6 and C6-7 with bilateral foraminal stenosis

- Claimant sustained lifting injury to the neck. Two level disc herniation. After two sets of cervical epidural steroid injections, injured worker underwent anterior cervical discectomy and fusion to C5-6 and C6-7. Claimant returned to work for the same employer.

- Claimant fell at work coming out of the main building, aggravating an underlying knee condition. Claim was settled in a contested posture because medical records showed client had been falling both before and after work injury due to unrelated medical conditions.

- Claimant was working part time and fell from a ladder to the concrete. Traumatic brain injury with multiple facial and orbital fractures. Both wrists sustained radial fractures with one requiring an open reduction and open fixation. Audiogram showed traumatic hearing loss.
