We are proud to report that Warnken, LLC recovered $13,228,300.35 for the injured in 2019.  Included in this was in excess of $10,000,000 in recoveries for workers injured on the job.  These recoveries were spread across 345 personal injury and workers’ compensation cases.

 

• Injury: Medial and lateral meniscal tear
• Body Part: Knee
• Employer: Care Ventures
• Location: Frederick, MD
• Amount: $33,696.00
• Claimant was injured while lifting a heavy patient at work. Claimant underwent surgery to repair the meniscal tear. Claimant had post-operative therapy and injections.

 

• Injury: Tear of the supraspinatus tendon
• Body Part: Shoulder
• Employer: State of Maryand
• Amount: $27,375.00
• Claimant was involved in a motor vehicle collision while working. Claimant had surgery to the shoulder and therapy. Claimant returned to pre-injury employment.

 

• Injury:             Lumbar strain, abdomen contusion

• Claimant was injured in a motor vehicle collision. Claimant was treated with medical visits for the injuries sustained.

 

• Injury: Bilateral de Quervain’s

• Due to overuse from work, Claimant developed de Quervain’s in both hands. Claimant had surgery on one hand and opted to pursue the surgery on the other hand at a later date.

 

• Injury: Femur Fracture

• Amount: $108,318.00 (including a $23,716.00 MSA)
• Claimant suffered a fall at work, breaking the femur. Claimant underwent surgery in the form of a hip IM nail repair. Claimant underwent physical therapy post-operatively.  Claimant developed an open sore on the left foot due to inactivity, which was treated with debridement and wound care.   The Medical Set Aside included lifelong care, including check-ups, MRI’s, etc. to the left leg.

 

• Injury: Bulging lumbar disc
• Body Part:      Back
• Amount: $25,000.00
• Claimant was injured on the job while lifting heavy supplies. Claimant was treated with physical therapy for several rounds.  Claimant also had an MRI of the lumbar spine, which revealed a disc bulge.  Claimant underwent several injections to the lumbar spine.  Claimant was unable to return to pre-injury employment due to permanent lifting restrictions.

• Claimant sustained an injury to the meniscus when he slipped and fell on ice. Claimant underwent an MRI of the knee, which revealed a tear or the meniscus tendon.  Claimant had the meniscus surgically repaired, followed by post-operative physical therapy, and was able to return to pre-injury employment.

 

• Injury: Partial Tear in the Bicep Tendon

• Claimant was lifting wood when he sustained a partial tear in the bicep tendon. Claimant underwent conservative treatment in the form of physical therapy, and was able to return to his pre-injury employment.

• Amount: $7,500.00
• Claimant was in a motor vehicle collision where the work vehicle was struck from behind. Claimant sustained a strain to the lumbar spine, and the wrist, as well as contusions to the leg. Claimant underwent conservative treatment in the form of physical therapy and was released to pre-injury employment.

• Claimant was injured when after slipping on ice while at work. Claimant was diagnosed with a cervicothoracic strain among other injuries.  Claimant underwent conservative care in the form of physical therapy, and was released to similar employment with a different company.

 

• Body Part: Head, plus separate knee injured that aggravated Osgood-Schlatter’s injury
• Amount: $18,500.00
• Claimant was struck in the head with a key, and diagnosed with an abrasion and concussion without loss of consciousness. He was treated with medication, underwent X-rays, and advised to avoid lights for several weeks.  For the knee injury, claimant underwent X-rays and scans, which revealed several sclerotic fragments with fluid and acute bone marrow edema compatible with a contusion.

• Employer: Shepard Pratt Hospital
• Claimant worked as mental health aide for Shephard Pratt Hospital and suffered a dislocated knee while working with patients. The knee was immobilized and the underwent physical therapy to strengthen the knee.  IW then sustained a new injury to the same leg about two weeks after return to work.  After a short period of occupational therapy, she again returned to work.

• Amount: $50,000.00.  Settlement
• Location: Baltimore County
• Employer: Harbor Towing
• Client was involved in a motor vehicle collision while driving a tow truck for work. After conservative care, the injured worker underwent cervical epidural steroid injections.  Surgery was recommended, but the injured worker elected not to undergo it.

 

 

• Body: Head, Neurological, Shoulder
• Amount: $51,450.00.  PPD Order
• Location: Carroll County
• Claimant fell from a ladder while working as a plumber. He struck his head and was knocked unconscious.  He also sustained a traumatic injury to the shoulder.  A shoulder MRI revealed tendonitis, a large amount of effusion, and a labral tear.  The Claimant underwent a shoulder arthroscopy to repair a rotator cuff tear, a subacromial decompression and a biceps tenotomy.  The injured worker underwent post-surgical therapy.  He was also diagnosed with a traumatic brain injury and underwent vestibular and cognitive therapies.  Claimant was eventually released to return to work with permanent restrictions, but was able to find a similar job within those restrictions with another employer.

• Amount: $207,940.00. Settlement
• Location: Western Maryland
• Employer: An Industrial Contracting Company
• Claimant sustained injury to his low back while loading heavy items. This aggravated an underlying back condition.  He was diagnosed with lumbar radiculopathy, lumbar fact arthropathy, and chronic pain syndrome.  During his care, he underwent a left hemilaminectomy and microdiscectomy.  Due to his chronic pain syndrome, a spinal cord stimulator.  He also underwent various transforaminal epidural steroid injections, nerve root injections, facet joint injections, and interlaminar joint injections.  Claimant had permanent work restrictions. While he was undergoing vocational rehabilitation, the Client elected to move out of state and retire.

• Client worked as a tractor trailer driver. While strapping down a load, he right foot became caught in the straps and he fell, landing awkwardly on his ankle.  He sustained a fractured right ankle and underwent emergency surgery for an Achilles tendon repair and Haglund’s debridement.  The injured worker progressed from non-weight bearing to post-surgical therapy.  After months of recovery, he returned to work as a tractor trailer driver.

• Defendant: An industrial company
• Client was working at a scrap dealer’s warehouse as part of an assignment with a temporary labor employer. While using an industrial shear, he sustained a partial amputation of his right ring finger.  He underwent emergency surgery for debridement and to repair the avulsion.   Part of the injured worker’s finger was not able to be saved.  After concluding his workers’ compensation claim, the injured worker brought suit against the owner of the warehouse and the shear.  A pre-trial settlement was reached.

• Employer: Penske Truck Leasing
• Claimant worked as a mechanic supervisor. While on a break, the injured worker sat down and the chair broke.  He fell to the concrete and sustained an impact injury to his back and left hip.  He underwent chiropractic care and eventually returned to work for the same employer in the same position.

• Amount: 25% PPD with 17% related to the accident and 8% for pre-existing permanency. $28,305.00

• Employer: State of Maryland
• Claimant worked in administration, budgeting and management for the State of Maryland. While coming down stairs, he slipped and sustained a twisting injury to his back, left hip, and left knee.  He underwent orthopedics and pain management care.  An MRI of the left knee revealed a tear of the medial meniscus.  The injured worker opted not to have surgery, but instead received a series of cortisone and Synvisc injections.  Imaging of his back revealed Grade I spondylolisthesis.  Surgery for his back was also recommended and again the Claimant opted not to have the surgery.  He did utilize a TENS unit and received acupuncture treatment, epidural steroid injections and eventually a rhizotomy.  Claimant retired from state employment soon after the injury on a pension and elected not to return to work.  He continues with his pain management regiment and with yearly orthopedic follow up examinations.

 

• Injury: Anterior Labral Tear of the Shoulder, Disk Protrusion of the Cervical Sprain, Headaches

• Claimant was involved in a motor vehicle collision during the course of employment and sustained injuries to the head, shoulder and neck. Claimant was treated with an MRI to the shoulder which showed an anterior labral tear.  Claimant was treated with injections and physical therapy before returning to preinjury employment.

• Claimant was working as a direct support professional and was attacked by a resident sustaining injury to their head and neck. Claimant was transported to the Emergency Room where an MRI was performed showing a possible nondisplaced occipital skull fracture. Follow up diagnostics could not confirm any fracture.  Claimant was treated with medication, physical therapy, and injections.

• Claimant was at work using a table saw and sustained a thumb injury. Claimant had surgery in the form of debridement of an open thumb phalanx fracture and thumb nail repair.  Claimant then had occupational therapy before returning to preinjury employment.

• Claimant sustained burns during the course of employment due to scalding hot water. Claimant was initially hospitalized and subsequently underwent physical therapy. The burns resulted in a large, permanent scar.

• Claimant was working as a physician’s assistant and sustained a back injury while examining patient. An MRI confirmed a disk herniation and the Claimant underwent surgery in the form of extraforaminal lateral microdiscectomy.

 

• Injury: Fractured metatarsal

• Location: Virginia
• Claimant’s foot was fractured when it was struck by a lift gate on the back of a truck. X-rays revealed a fracture on the second metatarsal. The Claimant’s foot was immobilized in a walking boot for approximately six weeks.

• Location: Forestville, Maryland
• Claimant slipped and fell from a work truck and sustained a humeral fracture. Initial conservative treatment resulted in a return to work after a four-month recovery. Claimant continued to work for another year until an MRI was performed due to ongoing symptomology.  The MRI revealed post traumatic arthritis and a proximal humerus malunion. As a result, Claimant underwent surgery in the form of a total shoulder replacement with open biceps tenodesis.  Following post-operative therapies the Claimant was able to return to preinjury employment.  Due to a substantial amount of unrelated, preexisting medical conditions or past injuries, the Claimant was awarded additional compensation from the Subsequent Injury Fund.
