October ’21 – Last Month’s Results: Warnken, LLC Recovered $1,801,770.87 for 32 Injured Clients

We’re not in the personal injury business for a quick buck or a quick recovery. We’re here to get the maximum compensation we can for our injured clients. Last month, thirty-two cases concluded, either permanently, or, in the case of some workers’ comp cases, for now. Of the 32, four cases produced recoveries to the injured client in excess of $100,000. Generally, cases over $100,000 represent well less than five percent of all injury cases. Some studies even put that number at about 1%. In our practice, that’s between 10-15%. The reason? We select clients with legitimate, serious injuries. And we aim never to leave a dollar on the table for our clients.

- Claimant sustained concussion and neck and back injury. Requests for psychological care denied by WCC and claim was appealed. Prior to hearing, Client sustained another work injury to the back. Both claims resolved together. Only two Dr visits for second claim.

- Injury: Electric shock injury to wrist and hand causing traumatically induced carpal tunnel syndrome with permanent nerve damage.

- Claimant sustained electrical shock injury to his hand and wrist while working part-time. Shock caused acute carpal tunnel syndrome and nerve damage. Claimant underwent injections, but declined surgery. After a period of VR, injured worker elected to look for work on his own. Low AWW ($296.26) due to PT work.

- Claimant sustained occupational hearing loss as a result of his employment with Bethlehem Steel Corp. The claim was settled on an appeal of a finding by the WCC that the hearing loss was caused by the worker’s employment. The settlement is “indemnity” only. All medical care for hearing loss remains open for future benefits. The value of this case was in covered for hearing aid and workers’ compensation hearing loss for the claimant’s life.

- Claimant sustained occupational hearing loss as a result of his employment with Bethlehem Steel Corp. Claimant died during claim and WCC found that Claimant’s Son was a Dependent. The claim was settled on an appeal of a finding by the WCC that the hearing loss was caused by the worker’s employment.

- Claimant sustained a hernia while moving a air conditioner. Claimant underwent surgical repair of the inguinal hernia with mesh. Post-surgery, the Claimant returned to work for the same employer.

- Injury: Fracture of the humeral shaft, complete rotator cuff rupture, shoulder dislocation, brachial artery injury, vein graft, carpal tunnel syndrome, depression
- Amount: $593,152
- Claimant sustained a partial amputation of his upper extremity when the worker’s arm and shoulder was crushed under a metal dock plate. Claimant was revived at the scene and taken to Shock Trauma. Claimant underwent multiple surgeries over many years, including an open reduction and internal fixation of the humeral shaft fracture due to a Gustilo-Anderson Type 3C humeral shaft fracture. Also an open right rotator cuff repair, vein grafting, brachial artery repair, open carpal tunnel release, neuroplasty and neurolysis and the radial nerve, repair of the non-union of the humerus, stellate ganglion bock due to complex regional pain syndrome. Claimant underwent 3 years of VR, but was not able to RTW. WCC found Claimant to be PTD. Claimant settled on appeal. Claimant also has already received $264,658.68 in prior indemnity benefits.

- Claimant sustained crush injury to his wrist while lowering a roll up door which malfunctioned. Injured worker underwent debridement and release of the first extensor compartment. After a period of vocational services, Claimant returned to work for a new employer. Award found 20% related PPD to the wrist and a period of contested TTD. TTD = $5,335.68.

- Client sustained inguinal hernia and underwent surgical repair. During recovery, Client continued experiencing scrotal pain and was sent to a urologist. Claimant was diagnosed with spermatic cord dysfunction and recommended for spermatic cord denervation. Claimant elected not to undergo that procedure.
