September ’21: Last Month’s Results, Warnken, LLC Recovered $1,901,931.08 for 49 Injured Clients

Last month, Warnken, LLC recovered close to two million dollars for our clients. Forty-nine cases produced a recovery last month. Of the 49, three cases resulted in recoveries to the injured client in excess of $100,000.

• Claimant was in a motor vehicle collision and aggravated the worker’s prior shoulder and neck conditions. Therapy for the shoulder. For the neck, the Claimant underwent Medial Branch Nerve Blocks from C3 to C5 and then a Rhizotomy from C3 to C6. Claimant continued to work for the Employer.

• Claimant sustained a fractured toe when striking a table. Claimant was immobilized and underwent therapy after fracture healed. Claimant returned to work for the employer.

• Claimant sustained a lifting injury to the back. Claim was contested and “disallowed” by the WCC stating that Claimant did not sustain an “accidental injury.” Decision was appealed and claim resolved during mediation.

• Claimant fell from a ladder and fractured the elbow. Eventually Claimant underwent a radial head arthroplasty and then a second surgery to remove deep hardware. Claimant returned to work for the employer in a lighter position. WCC decision appealed and the claim was settled for an additional amount plus a MSA.

• Claimant previously underwent surgery to repair her wrist. Additional “nerve wrap” surgery was recommended, but Client declined for now. Non-surgical care was therapy.

• Injury: Traumatic brain injury and post-traumatic stress disorder and depression

• Claimant sustained a traumatic brain injury when the worker struck a steel beam. Worker also sustained a neck injury and psychological damage. Claimant underwent treatment for a concussion, PTSD, and depression with a neurologist and psychologist.

• Claimant struck her hand and wrist on a stretcher while moving a patient. After therapy, Claimant returned to work for a different employer.

• Injury: Post traumatic headaches, acute sprain/strains of the neck and back, and a knee contusion.
• Amount: $14,000
• Client sustained head, neck, back and knee injuries in a work-related motor vehicle collision. The worker?s vehicle was struck by a hit and run driver. The injured worker underwent conservative care and returned to work for the same sedan service. This is the settlement of the uninsured motorist claim, which is money in addition to the workers’ compensation claim benefits

• Claimant sustained a hernia while lifting and moving a transmission. Surgical repair and injured worker returned to work for a different employer. Settlement included the payment of all outstanding medical bills, including the surgery. Claim was settled in a contested posture.

• Claimant sustained injury after striking the sharp corner of a piece of equipment. After a cortisone injection, the Claimant underwent a lateral fasciectomy and repair of the tendon. After a brief period of vocational rehabilitation, the injured worker returned to work full time with a new employer in a less physically demanding job.
